Conflict & Resolution

You have tried to save your relationship whether you are living together or married or in a civil partnership but things have got to the stage where you simply cannot deal with matters as they are any longer.

You come to the conclusion that there is no option but to separate even though that is not an easy decision. It can be a painful process getting to this stage.

Perhaps you are worried about how you will manage financially or how the children will cope. It is never an easy decision.

Of course these are very real worries and you need to consider your options carefully. You may find it useful to seek legal advice at the outset which may help you make decisions about your future and perhaps the future of your children.

Where there are children it means that you will probably need to be in contact with each other in some way for several years to come. This means that it is even more helpful if the route out of your relationship can be managed without litigation.

It is important to have solicitors that will work in a way that does not inflame the situation. Generally the matter is already difficult enough. That said of course you will need to know your options and to have a legal team that will look to obtain the best outcome for you but in a non-confrontational way wherever possible.

It is not absolutely necessary for you to have to go to Court in respect of your marriage, the finances relating to the marriage and most importantly about the care of the children. This is especially the case if you choose to use solicitors that belong to Resolution.

The Resolution Code of Practice promotes an approach to family law that is sensitive, constructive, cost-effective and most likely to result in an agreement. All solicitors who belong to Resolution should be promoting this practice.

Both Lynn and Anne are members of Resolution and support the practice.   At Bevan Evemy we view a court application being a last resort. Wherever possible we will attempt to negotiate a settlement and part of this process might be via mediation.
